As the FCC’s Further Notice of Proposed Rulemaking is underway, utilities are facing potentially significant changes to Federal regulations for pole attachments. These include deadlines for make ready, streamlined enforcement mechanisms, mandates to allow third party contractors, and -- last but not least -- lower rates for broadband attachments. This comes at a time when utilities are under increasing pressure to provide pole attachments from a wide variety of communications service providers, including wireless service providers. Finally, ILECs are arguing that they too should enjoy regulated rates and access, rather than share the costs with utilities under their joint use agreements.
